Data Protection Complaints Policy
This Data Protection Complaints Policy is effective as of 19th June 2026.
Power Island Limited is committed to protecting personal data and handling information fairly, lawfully and transparently.
This Data Protection Complaints Policy explains:
- how individuals can raise concerns or complaints about how their personal data has been collected, used, stored, shared or otherwise processed;
- how Power Island Limited will receive, investigate and respond to complaints;
- the rights individuals have to complain directly to us under the Data (Use and Access) Act 2025; and
- when concerns should be directed to the ICO rather than through this complaints process.
This policy applies to all personal data processed by Power Island Limited in connection with its activities, services, projects, communications and operations.
Data Protection Laws and Regulations
This policy operates in accordance with:
- the UK General Data Protection Regulation (UK GDPR);
- the Data Protection Act 2018; and
- the Data (Use and Access) Act 2025, including requirements relating to how organisations receive and respond to complaints from individuals about alleged infringements of UK data protection law.
Where legislation changes, this policy will be interpreted and updated accordingly.

What counts as a data protection complaint?
A Data Protection Complaint is a concern that Power Island Limited may have failed to comply with data protection law when handling personal data.
Examples include:
- collecting personal data without a valid lawful basis;
- using personal data for purposes not explained to the individual;
- sharing personal data without authority;
- retaining your personal data longer than necessary;
- inaccurate personal data not being corrected;
- failure to respond appropriately to a subject access request (SAR);
- insufficient security resulting in unauthorised access or disclosure;
- failure to respect consent choices;
- continued marketing from us after you had opted out;
- concerns about automated decision-making where applicable; or
- concerns about transparency or fairness in data processing.
What is not a data protection complaint?
The following would normally not be treated under this policy unless personal data handling is involved:
- general dissatisfaction with our service or programmes;
- complaints about staff conduct unrelated to personal information;
- disagreements with organisational decisions where no personal data issue exists;
- safeguarding concerns that do not involve information rights;
- requests for general information;
- complaints about website functionality unrelated to personal data;

- contractual disputes; or
- concerns already subject to legal proceedings unless they relate specifically to data protection rights.

Who can make a data protection complaint?
A Data Protection Complaint may be made by:
- an individual whose personal data is processed by Power Island Limited;
- a parent or legal guardian acting for a child where appropriate;
- an authorised representative acting on behalf of another individual;
- a former participant, volunteer, supporter, employee, contractor or service user whose personal data has been processed; or
- any person who believes their rights under UK data protection law have been affected.
Complaints may be submitted electronically, verbally or through any of the channels mentioned in our Contact Details section above.
How to make a data protection complaint
To begin investigating your complaint as quickly as possible, please provide the following information where possible:
- the complainant’s name and contact details;
- details of the concern;
- relevant dates;
- any supporting documents, e.g., reference numbers, screenshots, correspondence; and
- the outcome sought.
Power Island Limited will accept complaints submitted in accessible formats where required.

What happens when you submit a complaint?
Upon receiving a complaint, Power Island Limited will:
- acknowledge receipt within 30 calendar days. We will send you written acknowledgement confirming we have received your complaint and the date of receipt. Please note that day one of that period is the day after we receive it. We will confirm the person who will be handling the complaint, what will happen next and an expected timescale.
- begin a thorough investigation, which will include reviewing system logs, records, speaking with relevant suppliers and requesting additional information where necessary.
- Power Island Limited will keep the complainant informed throughout the investigation. If further information or details are required, or there are any changes, we will get in touch as soon as possible. We aim to provide a full response within one month of receiving a complaint; this may be extended by up to a further two months if the complaint is particularly complex.
- Provide an outcome explaining:
- our findings
- actions taken, or actions we will take
- reasons for our decisions, and
- further rights available to the complainant if you are not satisfied with the outcome.
If a complainant remains dissatisfied after receiving Power Island Limited’s response, they may raise the matter with the UK’s independent data protection regulator:

Making a complaint to Power Island Limited does not remove an individual’s right to complain to the regulator.
For our records
Records of complaints are held securely by Power Island Limited and are accessed only by those who are handling the matter. The ICO may request access to our records as part of its regulatory role and we are required to provide them if requested.
This policy will be reviewed periodically and updated to reflect changes in legislation, organisational practice and regulatory guidance.
